\n\t\t\t\tc)   Third Party Components. The software may include third party\n\t\t\t\tcomponents with separate legal notices or governed by other agreements, as may be described\n\t\t\t\tin the ThirdPartyNotices file(s) accompanying the software.\n\t\t\t

2.    DISTRIBUTABLE CODE.

\n\t\t\t\ta)   Distribution Rights.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\ti.          \n\t\t\t\tYou may copy and distribute the object code of the software; and\n\t\t\t

\n\t\t\t

\n\t\t\t\tii.          \n\t\t\t\tYou may permit distributors of your applications to copy and distribute any of this\n\t\t\t\tdistributable code you elect to distribute with your applications.\n\t\t\t

\n\t\t\t\tc)   Distribution Restrictions. You may not:\n\t\t\t

\n\t\t\t\ti.          \n\t\t\t\tuse Microsoft’s trademarks or trade dress in your application in any way that suggests your\n\t\t\t\tapplication comes from or is endorsed by Microsoft; or\n\t\t\t

\n\t\t\t\tii.          \n\t\t\t\tmodify or distribute the source code of any distributable code so that any part of it\n\t\t\t\tbecomes subject to any license that requires that the distributable code, any other part of\n\t\t\t\tthe software, or any of Microsoft’s other intellectual property be disclosed or distributed\n\t\t\t\tin source code form, or that others have the right to modify it; or\n\t\t\t

\n\t\t\t\tiii.          \n\t\t\t\tprovide any Microsoft download sites or shortcuts that provides access to this software to a\n\t\t\t\tthird party.\n\t\t\t

\n\t\t\t\t3.    DATA.\n\t\t\t

\n\t\t\t\ta)   Data Collection. The software may collect information about you and\n\t\t\t\tyour end users’ use of the software, and send that to Microsoft. Microsoft may use this\n\t\t\t\tinformation to provide services and improve our products and services. There are also some features in the software that may\n\t\t\t\tenable you to collect data from users of your applications. If you use these features to\n\t\t\t\tenable data collection in your applications, you must comply with applicable law, including\n\t\t\t\tproviding appropriate notices to users of your applications. You can learn more about data\n\t\t\t\tcollection and use in the help documentation and the privacy statement at https://aka.ms/privacy.\n\t\t\t\tYour use of the software operates\n\t\t\t\tas your consent to these practices.\n\t\t\t

\n\t\t\t\tb)   Microsoft Defender SmartScreen. Microsoft Defender SmartScreen\n\t\t\t\t(“SmartScreen”) is enabled by default. To the extent Microsoft is a processor or\n\t\t\t\tsubprocessor of personal data in connection with the software, Microsoft makes the\n\t\t\t\tcommitments in the European Union General Data Protection Regulation Terms of the Online\n\t\t\t\tServices Terms to all customers effective May 25, 2018, at https://learn.microsoft.com/en-us/legal/gdpr.\n\t\t\t

\n\t\t\t\t4.    SCOPE OF LICENSE. The software is licensed, not sold.\n\t\t\t\tMicrosoft reserves all other rights. Unless applicable law gives you more rights despite\n\t\t\t\tthis limitation, you will not (and have no right to):\n\t\t\t

\n\t\t\t\ta)   work around any technical limitations in the software that only allow\n\t\t\t\tyou to use it in certain ways;\n\t\t\t

\n\t\t\t\tb)   reverse engineer, decompile or disassemble the software, or otherwise\n\t\t\t\tattempt to derive the source code for the software, except and to the extent required by\n\t\t\t\tthird party licensing terms governing use of certain open source components that may be\n\t\t\t\tincluded in the software;\n\t\t\t

\n\t\t\t\tc)   remove, minimize, block, or modify any notices of Microsoft or its\n\t\t\t\tsuppliers in the software;\n\t\t\t

\n\t\t\t\td)   use the software in any way that is against the law or to create or\n\t\t\t\tpropagate malware; or\n\t\t\t

\n\n\t\t\t

\n\t\t\t\te)   share, publish, distribute, or lease the software, provide the\n\t\t\t\tsoftware as a stand-alone offering for others to use, or transfer the software or this\n\t\t\t\tagreement to any third party.\n\t\t\t

\n\t\t\t\t5.    H.264/AVC VIDEO STANDARD.. This product includes H.264/AVC \n\t\t\t\tcodec technology. MPEG LA LLC requires this notice:\n\t\t\t

\t\t\t\n\t\t\t\tTHIS PRODUCT IS LICENSED UNDER THE AVC PATENT PORTFOLIO LICENSE FOR THE PERSONAL AND NON-COMMERCIAL\n\t\t\t\tUSE OF A CONSUMER TO (i) ENCODE VIDEO IN COMPLIANCE WITH THE AVC STANDARD (“AVC VIDEO”) AND/OR (ii) \n\t\t\t\tDECODE AVC VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A PERSONAL AND NON-COMMERCIAL ACTIVITY \n\t\t\t\tAND/OR WAS OBTAINED FROM A VIDEO PROVIDER LICENSED TO PROVIDE AVC VIDEO. \n\t\t\tFor clarification purposes, this notice does not limit or inhibit the use of the product for normal \n\t\t\tbusiness uses that are personal to that business which do not include (i) redistribution of the product \n\t\t\tto third parties, or (ii) creation of content with AVC Standard compliant technologies for distribution \n\t\t\tto third parties.\n\t\t\t

\n\t\t\t\t6.    EXPORT RESTRICTIONS. You must comply with all domestic\n\t\t\t\tand international export laws and regulations that apply to the software, which include\n\t\t\t\trestrictions on destinations, end users, and end use. \n\t\t\t\t7.    SUPPORT SERVICES. Microsoft is not obligated under this agreement to\n\t\t\t\tprovide any support services for the software. Any support provided is “as is”, “with all faults”, and\n\t\t\t\twithout warranty of any kind.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t8.    UPDATES. The software may periodically check for updates, and\n\t\t\t\tdownload and install them for you or your end users. You may obtain updates only from Microsoft or\n\t\t\t\tauthorized sources. Microsoft may need to update your or your end users’ systems to provide you or your\n\t\t\t\tend users with updates. You agree to receive these automatic updates without any additional notice and\n\t\t\t\tyou agree to provide notice to your end users on Windows 7 or 8 devices as required under Section 9\n\t\t\t\tbelow. Updates may not include or support all existing software features, services, or peripheral\n\t\t\t\tdevices.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t9.    REQUIRED NOTICES TO END USERS. \n\t\t\t

\n\n\t\t\t

\n\t\t\t\ta)   Required SmartScreen notice. If you do not disable SmartScreen as described in\n\t\t\t\tSection 3(b) above, you must provide notice to all users that your software includes Microsoft Defender\n\t\t\t\tSmartScreen and collects and sends the end user’s information to Microsoft as disclosed in Microsoft’s\n\t\t\t\tPrivacy Statement at https://aka.ms/privacy and the Microsoft Edge Privacy Whitepaper at https://learn.microsoft.com/en-us/microsoft-edge/privacy-whitepaper#smartscreen.\n\t\t\t

\n\t\t\t

\n\t\t\t\tb)   Required Update Disclosure to Windows 7 and 8.1 end users. Per Section 8 above,\n\t\t\t\tyou must provide notice to your end users on Windows 7 and 8.1 devices that the software may\n\t\t\t\tperiodically check for updates, and download and install them on your end users’ devices without any\n\t\t\t\tadditional notice.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t10.    BINDING ARBITRATION AND CLASS ACTION WAIVER.This Section applies\n\t\t\t\t\tif you live in (or, if a business, your principal place of business is in) the United States. If\n\t\t\t\tyou and Microsoft have a dispute, you and Microsoft agree to try for 60 days to resolve it informally.\n\t\t\t\tIf you and Microsoft can’t, you and Microsoft agree to binding individual arbitration before the\n\t\t\t\t\tAmerican Arbitration Association under the Federal Arbitration Act (“FAA”), and not to sue in court\n\t\t\t\t\tin front of a judge or jury. Instead, a neutral arbitrator will decide. Class action\n\t\t\t\t\tlawsuits, class-wide arbitrations, private attorney-general actions, and any other proceeding where\n\t\t\t\t\tsomeone acts in a representative capacity are not allowed; nor is combining individual proceedings\n\t\t\t\t\twithout the consent of all parties. \n\n\t\t\t

\n\t\t\t\t11.    ENTIRE AGREEMENT. This agreement, and any other terms Microsoft may\n\t\t\t\tprovide for supplements, updates, or third-party applications, is the entire agreement for the software.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t12.    APPLICABLE LAW AND PLACE TO RESOLVE DISPUTES. If you acquired the\n\t\t\t\tsoftware in the United States or Canada, the laws of the state or province where you live (or, if a\n\t\t\t\tbusiness, where your principal place of business is located) govern the interpretation of this\n\t\t\t\tagreement, claims for its breach, and all other claims (including consumer protection, unfair\n\t\t\t\tcompetition, and tort claims), regardless of conflict of laws principles, except that the FAA governs\n\t\t\t\teverything related to arbitration. If you acquired the software in any other country, its laws apply,\n\t\t\t\texcept that the FAA governs everything related to arbitration. If U.S. federal jurisdiction exists, you\n\t\t\t\tand Microsoft consent to exclusive jurisdiction and venue in the federal court in King County,\n\t\t\t\tWashington for all disputes heard in court (excluding arbitration). If not, you and Microsoft consent to\n\t\t\t\texclusive jurisdiction and venue in the Superior Court of King County, Washington for all disputes heard\n\t\t\t\tin court (excluding arbitration).\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t13.    CONSUMER RIGHTS; REGIONAL VARIATIONS. This agreement describes\n\t\t\t\tcertain legal rights. You may have other rights, including consumer rights, under the laws of your\n\t\t\t\tstate, province, or country. Separate and apart from your relationship with Microsoft, you may also have\n\t\t\t\trights with respect to the party from which you acquired the software. This agreement does not change\n\t\t\t\tthose other rights if the laws of your state, province, or country do not permit it to do so. For\n\t\t\t\texample, if you acquired the software in one of the below regions, or mandatory country law applies,\n\t\t\t\tthen the following provisions apply to you:\n\t\t\t

\n\n\t\t\t

\n\t\t\t\ta)   Australia. You have statutory guarantees under the Australian Consumer Law and\n\t\t\t\tnothing in this agreement is intended to affect those rights.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\tb)   Canada. If you acquired this software in Canada, you may stop receiving updates by\n\t\t\t\tturning off the automatic update feature, disconnecting your device from the Internet (if and when you\n\t\t\t\tre-connect to the Internet, however, the software will resume checking for and installing updates), or\n\t\t\t\tuninstalling the software. The product documentation, if any, may also specify how to turn off updates\n\t\t\t\tfor your specific device or software.\n\t\t\t

\n\t\t\t\tc)   Germany and Austria.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t\n\t\t\t\t\ti.          \n\t\t\t\t\tWarranty.\n\t\t\t\t\n\t\t\t\tThe properly licensed software will perform substantially as described in any Microsoft materials that\n\t\t\t\taccompany the software. However, Microsoft gives no contractual guarantee in relation to the licensed\n\t\t\t\tsoftware.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t\n\t\t\t\t\tii.          \n\t\t\t\t\tLimitation of Liability.\n\t\t\t\t\n\t\t\t\tIn case of intentional conduct, gross negligence, claims based on the Product Liability Act, as well as,\n\t\t\t\tin case of death or personal or physical injury, Microsoft is liable according to the statutory law.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\tSubject to the foregoing clause ii., Microsoft will only be liable for slight negligence if Microsoft is\n\t\t\t\tin breach of such material contractual obligations, the fulfillment of which facilitate the due\n\t\t\t\tperformance of this agreement, the breach of which would endanger the purpose of this agreement and the\n\t\t\t\tcompliance with which a party may constantly trust in (so-called \"cardinal obligations\"). In other cases\n\t\t\t\tof slight negligence, Microsoft will not be liable for slight negligence.\n\t\t\t

\n\n\t\t\t

\n\t\t\t\t14.    DISCLAIMER OF WARRANTY. THE SOFTWARE IS LICENSED “AS IS.” YOU BEAR THE\n\t\t\t\t\tRISK OF USING IT. MICROSOFT GIVES NO EXPRESS WARRANTIES, GUARANTEES, OR CONDITIONS.
